Terms of Use
These Terms govern your use of the Instarecall application and website, provided by CTF Designs. By using Instarecall, you agree to these Terms. If you do not agree, do not use the service.
What Instarecall does
Instarecall helps you save shared links or text and schedule local reminders. It is an organizational aid, not a guaranteed alarm, emergency-alert system, calendar, professional service, or permanent backup.
Eligibility
You must be legally capable of agreeing to these Terms. If you use Instarecall on behalf of an organization, you represent that you have authority to bind it.
Your responsibilities
- Use Instarecall lawfully and respect third-party rights.
- Do not use it to store or distribute unlawful, infringing, malicious, or abusive content.
- Maintain appropriate device security and independent backups where needed.
- Do not rely on Instarecall for emergencies, medication, safety-critical actions, legal deadlines, financial obligations, or any matter where a delayed or missed notification could cause harm.
Third-party content
Instarecall may open links in third-party websites or apps. We do not control or endorse that content and are not affiliated with Instagram, Meta, TikTok, YouTube, Reddit, or other platforms unless expressly stated. Your use of third-party services is governed by their terms and policies.
Ownership
Instarecall, its design, software, branding, and original content are owned by CTF Designs or its licensors and protected by applicable law. You retain any rights you have in content you choose to save. These Terms do not grant us ownership of your reminders.
License
We grant you a limited, personal, revocable, nonexclusive, nontransferable license to use the app for lawful purposes under these Terms. You may not reverse engineer, interfere with, resell, or exploit the app except where applicable law permits.
UGC and social submissions
If you voluntarily send us a story, quote, image, or other content for possible promotional use, you keep ownership. We will request permission before publicly identifying you or using nonpublic submitted content in marketing. You represent that you have the right to submit it and that it does not violate another person's rights.
Updates and availability
We may update, change, suspend, or discontinue features. Device settings, battery optimization, operating-system behavior, network conditions, or software defects may delay or prevent notifications. We do not promise uninterrupted or error-free operation.
Disclaimer
To the maximum extent permitted by law, Instarecall is provided "as is" and "as available," without warranties of merchantability, fitness for a particular purpose, noninfringement, availability, or reliability.
Limitation of liability
To the maximum extent permitted by law, CTF Designs and its owner, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of data, lost profits, or losses caused by a missed or delayed reminder. Our aggregate liability arising from the free app or website will not exceed US $50 or the amount you paid us for Instarecall during the preceding twelve months, whichever is greater. Some jurisdictions do not permit certain limitations, so portions may not apply to you.
Indemnity
To the extent permitted by law, you agree to indemnify CTF Designs from claims arising from your unlawful misuse of Instarecall or violation of third-party rights.
Governing law
These Terms are governed by California law, excluding conflict-of-law principles. Courts located in Riverside County, California will have exclusive jurisdiction, except where consumer law requires otherwise.
Store terms
Apple and Google are not parties to these Terms and are not responsible for Instarecall, support, warranties, or claims. Your use must also comply with the applicable app store's terms. Where required, Apple and its subsidiaries are third-party beneficiaries of these Terms.
